This does not affect your statutory right, as a consumer, to receive goods that match their description and are of satisfactory quality.
SECTION 3 – ORDERS AND ACCEPTANCE
Placing an order constitutes an offer to purchase. NEWGARMENTS reserves the right to accept or decline any order for any reason, including availability, errors in pricing or product information, or suspected fraud.
An order is not considered accepted until payment has been successfully processed and confirmation has been issued. Once accepted, orders may not be cancelled or modified except as permitted under our Return & Refund Policy or under your statutory right of withdrawal (see Section 6).
Purchases are intended for personal use and may not be resold for commercial purposes.
SECTION 4 – PRICING, BILLING, AND PAYMENTS
All prices are listed in the applicable currency and are subject to change without notice. For consumers in the European Union and the United Kingdom, displayed prices include applicable VAT. Prices do not include shipping fees, and — for deliveries outside the country of dispatch — may not include customs duties or import charges, which are shown at checkout or may be payable on delivery where applicable.
You agree to provide valid and accurate payment information and authorize us to charge your selected payment method for the total order amount, including applicable taxes and shipping fees. You are responsible for ensuring payment details remain current.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times are estimates only. NEWGARMENTS is not responsible for delays caused by carriers, customs clearance, or events beyond our reasonable control; where you are a consumer, this does not affect your statutory rights in the event of late or non-delivery.
For consumers, risk of loss or damage to the goods passes to you only when you (or a third party indicated by you, other than the carrier) take physical possession of the goods. Title to the goods passes to you upon full payment or delivery, whichever occurs later.
SECTION 6 – RETURNS AND RIGHT OF WITHDRAWAL
Returns, refunds and — for consumers in the European Union and the United Kingdom — your statutory right to cancel or withdraw from your purchase are governed by our Return & Refund Policy, which forms part of these Terms. EU consumers may also exercise the right of withdrawal using the withdrawal function available via the “Withdraw contract” link in our footer and at https://newgarments.store/pages/eu-withdrawal-form.

SECTION 10 – RELATIONSHIP WITH SHOPIFY
NEWGARMENTS is powered by Shopify. All transactions are conducted directly between you and NEWGARMENTS. Shopify is not responsible for any aspect of sales, products, or customer service provided by NEWGARMENTS.

We reserve the right to correct any errors, inaccuracies, or omissions and to update information or cancel orders if necessary, even after an order has been submitted. Where an order you have already paid for is cancelled for this reason, we will refund you in full.

You agree not to misuse the Services, violate laws, infringe intellectual property rights, submit malicious code, or engage in conduct that harms NEWGARMENTS, Shopify, or other users.
SECTION 15 – TERMINATION
We may suspend or terminate access to the Services where you materially breach these Terms or where required by law. Termination does not affect any order already accepted or any statutory rights you have as a consumer. All obligations incurred prior to termination remain enforceable.
SECTION 16 – LEGAL GUARANTEE AND WARRANTIES
Products sold to consumers benefit from the statutory legal guarantee of conformity: goods must match their description, be of satisfactory quality and fit for their intended purpose, under the EU Consumer Sales Directive, the United Kingdom Consumer Rights Act 2015, and equivalent applicable laws. Nothing in these Terms excludes or limits this legal guarantee. Any additional voluntary warranty, where offered, is stated separately and does not affect your statutory rights.
SECTION 17 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, NEWGARMENTS shall not be liable for indirect, incidental, or consequential damages arising from the use of the Services. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your mandatory statutory consumer rights, or for any other liability that cannot be excluded or limited under applicable law.
SECTION 18 – INDEMNIFICATION
If you are acting for purposes relating to your trade, business or profession, you agree to indemnify and hold harmless NEWGARMENTS, Shopify, and their affiliates from claims arising out of your breach of these Terms or misuse of the Services. This section does not apply to consumers.
SECTION 19 – SEVERABILITY
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
SECTION 20 – ENTIRE AGREEMENT
These Terms, together with the policies referenced in them, constitute the entire agreement between you and NEWGARMENTS and supersede all prior agreements.
SECTION 21 – ASSIGNMENT
You may not assign your rights under these Terms without our consent. We may assign our rights and obligations under these Terms, provided this does not reduce the guarantees you have as a consumer.
SECTION 22 – GOVERNING LAW AND JURISDICTION
These Terms and any dispute arising from them are governed by the laws of the Netherlands. If you are a consumer, you additionally benefit from the mandatory consumer-protection provisions of the country in which you are resident, and nothing in these Terms deprives you of the protection of those provisions. Consumers may bring proceedings in the courts of their country of residence.

We may update these Terms at any time. The version in force is the one published on this page at the time you place your order. Continued use of the Services after changes are published constitutes acceptance of the updated Terms.
